1. INFORMATION ABOUT THE WEBSITE
This information and this website are owned by Be In Houses, trading under the name and trade mark “BE IN HOUSES” (hereinafter “BE IN HOUSES”).
BE IN HOUSES may be contacted via the available contact details, such as [telephone number to be inserted] or mailto:info@beinhouses.com.
The content of the website, including trademarks, logos, images and audio or video material, as well as all published articles and content, is the property of the owner, unless otherwise stated.
Use of the website to book or contract the Local Accommodation management services offered implies the customer’s/user’s acceptance of these terms and conditions, as well as their acknowledgement of the privacy policy.
All information uploaded by the user is their sole responsibility, and they undertake not to upload information belonging to third parties, or information that is offensive and/or infringes our rights, the rights of third parties or legal provisions.
A ‘user’ is defined as any natural or legal person who accesses the website.
A ‘customer’ is defined as any natural or legal person who makes a booking or contracts a Local Accommodation management service.
A ‘consumer’ is defined as a natural person acting for purposes outside the scope of their commercial, industrial, craft or professional activity.
References to the owner and users may be made in the singular or plural, without this affecting the content of these terms and conditions.
If you do not accept these terms and conditions and the privacy policy, please do not use this website.
2. Local Accommodation Management Services and Bookings
Through this website, the user may find out about the Local Accommodation management services provided by BE IN HOUSES and/or make booking requests for stays in the properties managed by the company, as well as contact the company to contract the Local Accommodation management service, in the case of property owners.
a) Property owners
The provision of the Local Accommodation management service is governed by the terms of the management contract entered into between BE IN HOUSES and the property owner, which sets out, in particular, the terms of remuneration, the duration, exclusivity and the obligations of each party. These terms and conditions apply in addition to the aforementioned contract, in respect of any matters not specifically provided for therein.
b) Guests / booking
Bookings may be made via booking platforms (such as Booking.com, Airbnb or VRBO) or directly via BE IN HOUSES’ contact details.
No booking is considered confirmed until payment of the amount due, as stated at the time of booking (either the full amount or a deposit, as applicable).
The conditions for check-in, check-out, cancellation and any refunds are those indicated on the page for each listing/property or those applied by the platform through which the booking was made, with the latter taking precedence when the booking is made via an intermediary platform.
The guest undertakes to make proper use of the property and its facilities, and is liable for any damage caused during their stay, without prejudice to the possible retention of a security deposit, where applicable.
By making a booking, the user declares that they have read and accepted these terms and conditions, as well as the privacy policy.
All personal data collected will be processed in accordance with applicable law; further details can be found in our Privacy Policy.
3. RIGHT OF WITHDRAWAL
Under the terms of Decree-Law No. 24/2014 of 14 February, the right of withdrawal does not apply to contracts for the provision of accommodation services where these specify a particular date or period of performance; this exception applies to services relating to leisure activities, accommodation and transport with a fixed date or period.
Notwithstanding the above, the cancellation conditions and any applicable refunds for each booking are set out in the advert or on the platform through which the booking was made, as indicated in the previous article.
4. NEWSLETTER AND/OR WAITING LISTS
Via this page, the user may subscribe to the NEWSLETTER.
In exchange for subscribing to the NEWSLETTER, which is provided in non-physical form, the user provides personal data, such as their name and email address, for the purpose of receiving further content and services relating to the management of Local Accommodation and accommodation in the region.
All information uploaded by the user is their sole responsibility, and they undertake not to upload information belonging to third parties, or which is offensive and/or infringes our rights, those of third parties or legal provisions.
The user has the right to request cancellation of their subscription at any time.
Users may join waiting lists for our services, for which they provide personal data such as their name, email address and telephone number.
5. DISPUTES
In the event of a dispute, the parties undertake to make every effort to resolve it out of court.
This contractual relationship is governed by Portuguese law.
In the event of a dispute, the competent court shall be the District Court of [district to be filled in, depending on the company’s registered office/address].
You may submit your complaint via the Electronic Complaints Book, available at www.livroreclamacoes.pt (http://www.livroreclamacoes.pt/), by searching for BE IN HOUSES.
Without prejudice to the foregoing, the consumer may also refer the matter to an alternative dispute resolution body for consumer disputes, in accordance with Law No. 144/2015 of 8 September.
6. FURTHER INFORMATION
This website has been created for the personal use of the owner’s customers and/or potential customers, through which they may learn about the Local Accommodation management services offered and make bookings.
Please note that the content, services, terms of use of the website and the privacy policy may be modified by the owner, as permitted by applicable law, where such changes are required by law or relate to the expansion or introduction of new services and/or features, or any other changes that may prove necessary. The website owner will use its best endeavours to indicate, in writing or online, the date of the last update. Nevertheless, you are advised to check the website regularly.
By accessing the website, you agree not to use it, or its content, in breach of any legal provision, nor to reproduce, modify or transmit its content for any public or private purpose without the prior and express written consent of the website owner.
